Welcome to Comfort Living. These Terms of Service ("Terms") govern your use of comfortlivingla.com (the "Site") and the products and services offered by Comfort Living, operating at 11420 Long Beach Blvd, Lynwood, CA 90262 ("Comfort Living," "we," "us," "our"). By accessing the Site, submitting a lead form, visiting our store, or purchasing from us, you agree to be bound by these Terms. If you do not agree, do not use the Site or our services.

1. Eligibility & Account

You must be at least 18 years old and legally able to enter into a binding contract under California law to purchase from or enter into a financing agreement through Comfort Living. By using the Site or purchasing from us, you represent that you meet these requirements. You agree to provide accurate, current, and complete information and to update it promptly when changes occur.

2. Products, Pricing & Availability

We offer furniture packages and individual pieces sourced from Furniture of America, Poundex, and other suppliers. Product descriptions, dimensions, colors, and images on the Site are provided for informational purposes and may vary slightly from the actual product. We reserve the right to:

  • Modify or discontinue any product, package, or offer at any time without notice.
  • Limit quantities available for any product or package.
  • Correct typographical errors in pricing, availability, or product information at any time — including after an order has been placed but before it has been fulfilled.
  • Refuse service to anyone at our sole discretion.

All prices are in U.S. dollars and exclude applicable taxes unless otherwise stated. Pricing displayed on the Site supersedes any pricing in prior materials but is subject to confirmation at the time of order.

3. Orders, Payment & Delivery

When you submit an order — in-store, by phone, or through our site — you make an offer to purchase. Your order is not accepted until we confirm it and receive payment (or financing approval). We may decline any order for any lawful reason, including inventory limitations, suspected fraud, or inability to verify information.

Payment: We accept cash, major credit and debit cards, and approved third-party financing from our partners. Full payment (or approved financing) is required before delivery is scheduled.

Delivery: Delivery is provided at no extra charge within our service area (Southeast Los Angeles and surrounding neighborhoods). Delivery dates are estimates, not guarantees. We are not liable for delays caused by supplier shortages, weather, carrier issues, or events beyond our reasonable control.

Risk of loss: Title and risk of loss pass to you upon delivery and setup completion at your address.

4. Returns, Cancellations & Refunds

  • Cancellations before delivery: you may cancel an unshipped order for a full refund by calling us within 24 hours of placing the order.
  • Returns after delivery: due to the nature of the furniture industry, all sales after delivery and setup are final, except for items that are defective, damaged in delivery, or materially not as described. Defects must be reported within 48 hours of delivery.
  • Custom or special-order items: non-refundable and non-returnable once ordered from the supplier.
  • Refund processing: approved refunds are issued to the original payment method within 7–10 business days. Financed purchases follow the refund terms of the financing partner.

5. Limited Warranty

Comfort Living passes through the manufacturer's warranty that accompanies each product. We do not provide an independent warranty beyond what the manufacturer offers. Typical manufacturer warranties cover defects in materials and workmanship for a limited period (often 1 year from delivery) and exclude damage caused by normal wear, misuse, accidents, and improper care. Original proof of purchase is required for any warranty claim.

6. Third-Party Financing Disclaimer

Comfort Living partners with independent lease-to-own and financing companies — Acima LeasingSnap Finance, and Progressive Leasing — to provide payment options for qualifying customers. These providers are separate legal entities and are not affiliated with, owned by, or controlled by Comfort Living.

  • Approval decisions are made solely by the financing partner based on their criteria. Comfort Living has no role in approving, denying, or setting the terms of any financing agreement.
  • Any lease-to-own or financing agreement is strictly between you and the financing partner, governed by their disclosures, terms, and applicable state and federal law.
  • Financing partners may charge fees, interest, or lease costs that result in a total cost higher than the cash price. Review their disclosures carefully before signing.
  • Comfort Living is not responsible for any dispute, billing issue, collection action, or credit consequence arising from your agreement with a financing partner. Direct all such matters to the partner.
  • The availability of any financing option is not a guarantee of approval.

7. SMS Program Terms

Comfort Living operates an SMS / text-messaging program for customers and prospective customers. By providing your mobile number through any of our forms (website, Facebook/Instagram Instant Forms) or in person at our showroom, you agree to these SMS Program Terms in addition to the rest of these Terms.

1. Program description

The texts you receive from Comfort Living fall into three categories:

  • Inquiry follow-ups — confirmation that we received your inquiry, plus messages to help you schedule a showroom visit or phone consultation.
  • Order & delivery status updates — order received, delivery scheduled, out for delivery, delivered, including tracking links when available.
  • Customer-service messages — appointment reminders, replies to your questions, and warranty or after-sale follow-ups.

2. Message frequency

Message frequency varies based on your interaction with us — typically 2 to 8 messages per inquiry or order.

3. Cost

Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

4. Supported carriers

The SMS program is supported on AT&T, Verizon, T-Mobile, Sprint, Boost, Cricket, MetroPCS, U.S. Cellular, and others.

5. Opting out (STOP)

You can opt out of the SMS program at any time by replying with any of the following keywords to any message we send: STOPENDCANCELUNSUBSCRIBEQUIT, or STOPALL. After you opt out, we will send a single confirmation message acknowledging that you have unsubscribed, and you will receive no further SMS messages from the program. You can re-subscribe at any time by replying START.

7. Eligibility

You must be at least 18 years old and either the account holder of the mobile number you provide, or authorized by the account holder to enroll that number in the SMS program. You are responsible for any charges incurred by the carrier for SMS messages you receive on a number you do not have authority to enroll.

8. Mobile information sharing

Mobile Information Sharing — Important

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support of our services is permitted. All other categories of personal information described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties for any purpose other than operating the SMS program.

9. Service provider

The SMS program is operated using Twilio Inc. as our messaging service provider. For information about how Twilio handles data on our behalf, see the Twilio Privacy Notice.

8. Other Communications

Apart from SMS, we may also contact you by phone call or email regarding your inquiry, order, delivery, warranty claim, or related customer-service matters. By providing your phone number or email address to us, you consent to receive these communications.

Opting out of the SMS program (Section 7) does not affect our ability to call or email you about an existing inquiry or order. To stop receiving phone calls or emails, contact us directly at info@comfortlivingla.com or (323) 357-4500; we will continue to call or email only as needed to fulfill an existing transaction or as required by law.

9. Intellectual Property & Scraping

Apart from SMS, we may also contact you by phone call or email regarding your inquiry, order, delivery, warranty claim, or related customer-service matters. By providing your phone number or email address to us, you consent to receive these communications.

Opting out of the SMS program (Section 7) does not affect our ability to call or email you about an existing inquiry or order. 10. Acceptable Use

You agree not to use the Site or our services to:

  • Submit false, misleading, or fraudulent information on any form.
  • Impersonate another person or misrepresent your affiliation.
  • Upload or transmit malicious code, viruses, or any material intended to disrupt or damage our systems.
  • Attempt to gain unauthorized access to any account, computer system, or network associated with the Site.
  • Harass, threaten, or send abusive communications to our staff.
  • Violate any applicable federal, state, or local law.

11. Disclaimers & Limits of Liability

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMFORT LIVING DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

LIMITATION OF LIABILITY.TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMFORT LIVING AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL — ARISING FROM OR RELATED TO YOUR USE OF THE SITE, OUR PRODUCTS, OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO COMFORT LIVING FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify, defend, and hold harmless Comfort Living and its owners, employees, and agents from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising from or related to: (a) your breach of these Terms; (b) your misuse of the Site or our services; (c) your violation of any law or third-party right; or (d) any content you submit through our forms or communications.

13.Governing Law

These Terms and any dispute arising from them are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Subject to the arbitration clause below, the exclusive venue for any non-arbitrable dispute is the state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.

14.Arbitration & Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Except for (a) small-claims court actions and (b) claims for injunctive relief to protect intellectual property or enforce the scraping prohibition in Section 9, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or our products or services will be resolved by final and binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in Los Angeles County, California, in English, before a single arbitrator. Judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

Class-action waiver: you and Comfort Living each waive the right to bring or participate in any class action, collective action, or representative proceeding. The arbitrator may not consolidate claims of more than one individual or preside over any class or representative proceeding. If a court decides that this class-action waiver is unenforceable, the arbitration clause will be void, and the parties may proceed in court.

Opt-out: you may opt out of this arbitration clause by sending written notice to info@comfortlivingla.com within 30 days of first accepting these Terms. The notice must include your name, mailing address, and a clear statement of your intent to opt out. Opting out will not affect any other part of these Terms.

15. Termination

We may suspend or terminate your access to the Site — or refuse service — at any time, with or without notice, for any reason, including any violation of these Terms. Sections that by their nature should survive termination (including Sections 9, 11, 12, 13, and 14) will survive.

16. Changes To These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of the page. Material changes will be announced via a notice on the Site. Your continued use of the Site or services after the effective date of any change constitutes your acceptance of the updated Terms. If you do not agree, discontinue use.
